1. Acceptance of Terms

By downloading, installing, or using SiteSnap ("the App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of SiteSnap, including free and paid subscribers. By creating an account, you confirm you are at least 16 years of age and have the legal capacity to enter into a binding agreement.

2. Description of Service

SiteSnap is a mobile and web application for construction professionals that enables you to:

• Capture, organise, and store site photographs by project
• Add GPS tags, descriptions, and metadata to photos
• Generate professional PDF reports for clients and disputes
• Share projects and photos with team members
• Create a portfolio of completed work
• Record before and after documentation of site progress

3. Accounts and Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorised access to your account
• You may not share your account credentials with others — team access requires an appropriate subscription tier
• One paid subscription per account owner; members added via the Team feature access the owner's subscription

5. Acceptable Use

You agree not to use SiteSnap to:

• Upload illegal, harmful, threatening, or offensive content
• Infringe the intellectual property rights of any person or entity
• Impersonate any person, company, or organisation
• Transmit viruses, malware, or other harmful or disruptive code
• Attempt to gain unauthorised access to our systems or another user's account
• Use the service for any unlawful purpose or in breach of any regulation
• Scrape, copy, sell, or redistribute our software, infrastructure, or data
• Use automated tools to excessively query or load our servers

6. Your Content and Data Ownership

• You retain full ownership of all photographs, documents, and data you upload to SiteSnap
• By uploading content, you grant SiteSnap a limited, non-exclusive, royalty-free licence to store, process, and display that content solely for the purpose of providing the service to you
• We do not use your content for training AI models or for any commercial purpose beyond service provision
• You are responsible for ensuring you have the right to upload any content you add to SiteSnap
• You can export all your data at any time from Account Settings and delete your account when you choose

7. Intellectual Property

The SiteSnap name, logo, app design, and underlying software are the intellectual property of SiteSnap and are protected by copyright and trade mark law. You may not copy, modify, distribute, reverse-engineer, or create derivative works of our software without express written permission.

8. Privacy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using SiteSnap, you consent to the data practices described in our Privacy Policy.

9. Disclaimers

• SiteSnap is provided "as is" without warranty of any kind, express or implied
• We do not guarantee the App will be error-free or uninterrupted at all times
• Photos taken via SiteSnap are for record-keeping purposes only; we make no warranty as to their admissibility as legal evidence in any court or dispute resolution proceeding
• SiteSnap is a documentation tool — we are not responsible for any construction defects, contractual disputes, or financial losses arising from your use of the App
• We are not responsible for service interruptions caused by third-party providers (hosting, payments, etc.)

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• SiteSnap's total liability to you for any claim arising from your use of the service shall not exceed the total fees you paid to SiteSnap in the 12 months immediately preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities
• We are not liable for loss of data caused by factors outside our control, including device failure, network outages, or third-party service failures

Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

11. Termination

• You may delete your account at any time through Account Settings. All your personal data will be permanently removed within 30 days of account deletion
• We may suspend or terminate your account without prior notice if you materially breach these Terms, engage in fraudulent activity, or if required to do so by law
• Upon termination, your licence to use SiteSnap ceases immediately
• Sections relating to intellectual property, limitation of liability, and governing law survive termination

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We may update these Terms from time to time to reflect changes to our service, legal requirements, or business practices. We will notify you of material changes via email or in-app notification with at least 14 days' notice. The "Last updated" date at the top reflects the most recent revision. Continued use of SiteSnap after changes take effect constitutes your acceptance of the updated Terms.
